Terms of Service
1. Introduction
These terms govern your use of Vieressa, a video phone service for elderly care operated by Here and Now Consulting Oy (Business ID: 3009606-6). By using Vieressa, you agree to these terms.
2. Eligibility
You must be at least 18 years old to create an account. Accounts for elderly users may be created and managed by authorized family members or caregivers.
3. Your Account
You are responsible for maintaining the security of your account credentials. Each person should have only one account. You may change your username or email address through your profile settings. Notify us immediately of any unauthorized access.
4. Service Description
Vieressa provides: video calls between a loved one and their family circle (including group calls of up to four participants), voicemail for video and audio messages, family photos on the loved one's device, device management (settings and contacts), notifications for the family (for example the device's battery level), and profile image uploads for contact identification. Availability depends on the internet connection and the devices used. The service is available through the Vieressa web application and the Android and iOS apps; incoming-call notifications are delivered through Google Firebase Cloud Messaging (Android) and the Apple Push Notification service (iOS). The service tiers and their contents are described at www.vieressa.fi/en/hinnat. Planned features such as a Microsoft Teams connection and the Status tier (summaries of how your loved one is doing) are not yet in use; their introduction and terms will be communicated before they are taken into use.
Intended use
Vieressa is intended for keeping in touch between a person who needs the service and their close circle (family, friends, carers). The service may not be used for public broadcasts, continuous streaming, commercial communication, automated use or any purpose other than the one described above. Here and Now Consulting Oy may restrict or close a subscription if use deviates materially from this purpose. Before closing, the family administrator is notified and given the opportunity to correct the use, unless the case is obvious abuse.
Subscription, trial and payments
The trial lasts 30 days on the Plus tier. It does not require a payment card and does not become a paid subscription unless the family administrator chooses a tier and provides a payment card. After the trial the family has a 14-day activation period during which the loved one can still call the family; when a subscription is activated within that period, billing starts from the day the trial ended. Prices are Basic €7.90 and Plus €11.90 per month per loved one, VAT included; the price covers every member of the loved one's family circle. Prices and tier contents are described at www.vieressa.fi/en/hinnat. The subscription runs until further notice one month at a time and is charged monthly in advance to the payment card. Payments are processed by Stripe (Stripe Payments Europe Ltd.); Here and Now Consulting Oy does not store payment card details. The subscription can be cancelled at any time on the Family page of the app, in which case it ends at the end of the current billing period and no refund is made for the unused time. If a payment fails, the charge is retried, and if it does not succeed within 14 days the subscription is paused: the loved one can call the family, but the family cannot call the loved one until the payment has been made. Consumers have a 14-day right of withdrawal from the start of the subscription; because the service is taken into use immediately at your request, the unused part of the paid period is refunded on withdrawal. Price changes are announced at least 30 days in advance and apply to billing periods starting after the notice. Organisation customers are agreed with separately.
5. Prohibited Use
You may not: use the service to harass, intimidate, or harm others; attempt to gain unauthorized access to accounts or systems; use the service for any unlawful purpose; interfere with the operation or security of the service; or share your credentials with third parties. The service may not be used for public broadcasts, continuous streaming, commercial communication or automated use (see Intended use). Accounts are personal; one subscription may not be used to provide the service to more loved ones than the subscription covers.
6. Intellectual Property
Here and Now Consulting Oy owns all rights to the Vieressa service, including software, design, and branding. You retain ownership of your personal data and any content you create.
7. Limitation of Liability
The service is provided "as is" without warranties. Vieressa is not a medical device or a healthcare service and does not replace professional healthcare. Here and Now Consulting Oy is not liable for indirect, incidental, or consequential damages arising from use of the service.
8. Termination
You may delete your account at any time through your profile settings; the family administrator can cancel the subscription on the Family page. We may suspend or terminate your access if you violate these terms or if use deviates materially from the intended use of the service. Before closing, the family administrator is notified and given the opportunity to correct the use, unless the case is obvious abuse or unlawful activity. If Here and Now Consulting Oy ends a subscription for a reason other than the user's breach, the unused paid period is refunded. Upon termination, your data is handled in accordance with our Privacy Policy.
9. Changes to Terms
We may update these terms from time to time. Material changes will be communicated through the service, and you may be asked to re-accept the updated terms.
10. Governing Law
These terms are governed by Finnish law. Disputes shall be resolved in the District Court of Helsinki, Finland.
